  1. We are RFK Original, a limited liability company (LLC) registered and incorporated under the laws of The United States of America, trading internationally with our registered office and main trading address being 126-15 Foch Boulevard Boulevard, Suite 056 South Ozone Park NY 11420-0056.

  2. We operate several sites and social platforms, with this site - www.rfkoriginal.com - being the primary site.

  3. These Terms and Conditions apply to the use of the Website of RFK Original. By using our Website or the Services you agree to the applicability of these Terms and Conditions thereto. If you do not agree to them you should not use the Website or the Services.

  4. We reserve the right, from time to time, to change these Terms and Conditions at our sole discretion. The Terms and Conditions applicable to your access to and use of this Website and your use and/or purchase of RFK Original’s Services will be the version that is current and displayed on the Website as at each date you access the Website or use RFK Original’s Services (as applicable). Your use of this Website or your use of RFK Original’s Services after changes are made, means that you agree to be bound by such changes.

Use of the Website and Services

  1. The Customer shall not use RFK Original’s Website or Services to access, store, distribute or transmit any viruses, or upload any material via the Website or using the Services that:

    1. is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive;

    2. infringes on third parties intellectual property rights;

    3. facilitates illegal activity;

    4. promotes unlawful violence;

    5. is discriminatory based on race, gender, color, religious belief, sexual orientation, disability, or any other illegal activity; or

    6. causes damage or injury to any person or property;

    Customer indemnifies RFK Original for any breach of this clause by it or its Authorised Users or any breach resulting from the unauthorised use by a third party of the log-in information of an Authorised User, and RFK Original reserves the right, without liability to the Customer, to disable the Customer’s access to any material that breaches the provisions of this clause.

  2. The Customer shall not, except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties, or except as explicitly agreed otherwise between Parties:

    1. use the Website and/or Services to provide services to third parties; or

    2. license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the Website and/or Services available to any third party except the Authorised Users, or

    3. attempt to obtain, or assist any person other than Authorised Users in obtaining access to the Website and/or Services.

  3. The Customer shall use all reasonable endeavours to prevent any unauthorised access to, or use of, the Services and/or the Website and, in the event of any such unauthorised access or use, promptly notify RFK Original.

  4. The rights provided under this Agreement are granted to the Customer only, and shall not be considered granted to any subsidiary or holding company of the Customer.

  1. Services

    1. RFK Oiginal LLC shall use commercially reasonable endeavours to make the Services available 24 hours a day, seven days a week, except for:

      1. planned maintenance; and

      2. unscheduled maintenance.
